Tuesday, November 18, 1997

The regular meeting of the Board of Embalmers and Funeral Directors was held in the Board's offices in the Riffe Center at 77 South High Street, 16th Floor, Columbus, Ohio. The meeting was called to order at 1:05 P.M. by Board President, Robert L. Shank. Other Board members present were: Ross C. DeJohn, John J. Hadley, Roger Primm, and Jane Stalzer. Also present were: Paul E. DeWeese, Inspector; Terri W. Meldrum, Assistant Attorney General; and Ann Cunningham, Executive Director.

On a motion by Mr. Hadley, seconded by Mr. DeJohn, the minutes of the October 14-15, 1997, Board meeting were approved. Ayes: 5. Nays: 0. Motion approved.

On a motion by Mr. Hadley, seconded by Mrs. Stalzer, the minutes of the October 27-28, 1997, examinations were approved. Ayes: 5. Nays: 0. Motion approved.

After reviewing the 1998 meeting schedule, President Shank announced that the March 1998 Board meeting will be changed from Tuesday, March 17 to Wednesday, March 18, 1998, and the July meeting will be one day. Also, the Board decided to meet at 11:30 A.M. at the Doubletree Guest Suites Hotel for the annual holiday luncheon.

The Board reviewed the grades of the embalmer Ohio laws examinations and the Funeral Service Arts and Science examinations written October 27-28, 1997. Motion by Mr. Hadley, seconded by Mrs. Stalzer, that applicants with a score of 70% or higher on the examinations be granted embalmer interne certificates, starting with number D-3804 through D-2843. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye. Motion approved. A list of applicants, their scores and interne numbers will be entered into the journal.

Motion by Mr. Hadley, seconded by Mrs. Stalzer, to issue reciprocal embalmer licenses to applicants with a score of 70% or higher (West Virginia applicants must earn a score of 75% or higher) on the embalmer Ohio laws examinations pending receipt of the initial fee. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye. Motion approved. A list of licensees, their scores and license numbers will be entered into the journal.

The Board reviewed the funeral director Ohio laws, sanitation and Funeral Service Arts examinations written on October 27-28, 1997. Motion by Mr. DeJohn, seconded by Mr. Primm, that applicants with a score of 70% of higher on these examinations be granted funeral director licenses, starting with number 8441 through number 8485. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye. Motion approved. A list of licensees, their scores and license numbers will be entered into the journal.

Motion by Mr. DeJohn, seconded by Mr. Primm, to issue reciprocal funeral director licenses to those with a score of 70% or higher (West Virginia applicants must earn a score o 75% or higher), pending receipt of the initial fee. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye. Motion approved. A list of licensees, their scores and license numbers will be entered into the journal.

Inspectors' Reports

President Shank read Inspector Savage's report that he drove 1,833 miles in the counties of Ashland, Belmont, Columbiana, Cuyahoga, Jefferson, and Stark.. He made 25 inspections, six investigations, found no violations and monitored three apprentices.

Inspector DeWeese reported that he drove 1,993 miles in the counties of Clark, Defiance, Franklin, Hancock, Henry, Montgomery, Scioto, Williams, and Wood. He made 36 inspections, twelve investigations, found no violations, and did not monitor any apprentices.

On a motion by Mrs. Stalzer, seconded by Mr. Hadley, the Board went into executive session pursuant to Section 121.22 (G) (1) of the Ohio Revised Code, to consider complaints and possible disciplinary action against licensees, and Section 121.22 (G)(3) of the Ohio Revised Code to conference with the Board's counsel to consider pending litigation. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye.

Board members, Ronald G. Van Atta and Kurtis A. Tunnell, joined the Board meeting during executive session.

On a motion by Mr. Hadley, seconded by Mr. DeJohn, the Board came out of executive session. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye, Tunnell, Aye; Van Atta, Aye.

On March 20, 1996, the Board voted to charge Patrick R. Barclay and the Barclay Funeral Home with violation of Section 4717.08(I) of the Ohio Revised Code, for false, misleading and deceptive advertising for the listing in the business section of the Ameritech 1996-97 PagesPlus white pages, Dayton and vicinity. Upon receiving further information, and on a motion by Mr. Hadley, seconded by Mr. DeJohn, the Board voted to dismiss that portion of the charge. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Tunnell, Aye; Van Atta, Aye. Motion approved.

On a motion by Mr. Hadley, seconded by Mr. DeJohn, the Board voted to close eleven investigatory files. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Tunnell, Aye; Van Atta, Aye. Motion approved.

On a motion by Mr. Hadley, seconded by Mr. DeJohn, the Board voted to order Jeffrey L. Brant to cease and desist from using "Windel-Howland' in any advertisement including telephone directories. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Tunnell, Aye; Van Atta, Aye. Motion approved.

On January 15, 1997, the Board voted to charge Joseph T. Paquelet, Wayne W. Arnold, Glenn M. Dumoulin and the Arnold-Lynch Funeral Home, with violation of Section 4717.08 (I) of the Ohio Revised Code, for false, misleading, and deceptive advertising. On a motion by Mr. Hadley, seconded by Mrs. Stalzer, the Board voted to dismiss the charge against Joseph T. Paquelet. Roll call vote: DeJohn, Aye; Hadley, Aye; Primm, Aye; Shank, Aye; Stalzer, Aye; Tunnell, Aye; Van Atta, Aye. Motion approved.

Unfinished Business

The Board discussed the approval of Senate Bill #117 by the Senate on November 13, 1997, and the hearing process that will now begin in the Ohio House. Board members and interested parties will be notified of all scheduled hearings.

The Board received copies of the newly revised National Board Examination Study Guide produced by the Conference of Funeral Service Examining Boards in Utah.

1. A letter from Meghen Phillips concerning late registration. On a motion by Mr. Tunnell, seconded by Mrs. Stalzer, the Board approved her request to register late. Ayes: 7. Nays: 0. Motion approved.

2. A letter from Jeffrey N. Schertzer concerning late registration. On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved his request for late registration provided he qualifies. Ayes: 7. Nays: 0. Motion approved.

3. A letter form Richard T. Bissler concerning a change in firm title. On a motion by Mr. DeJohn, seconded by Mr. Tunnell, the Board the change from "S. C. Bissler & sons, Inc." to "Bissler & Sons Funeral Home." Ayes: 7. Nays: 0. Motion approved.

4. A letter from Joseph A. Marsaglia, Jr. of the Pittsburgh Institute of Mortuary Science, Inc. concerning a Funeral Service Law Seminar. On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board voted to send Mr. DeJohn and Mr. Savage to the Pittsburgh Institute of Mortuary Science to speak to the students on December 2, 1997. Ayes: 7. Nays: 0. Motion approved.

5. A letter from Jon Dietloff, SCI Cluster Manager - Southwestern Ohio confirming the discussion of establishment names in the proposed legislation.

6. A letter from Todd Capps concerning late registration. On a motion by Mr. Tunnell, seconded by Mr. Hadley, the Board approved his request to register late. Ayes: 7. Nays: 0. Motion approved.

7. A letter from Christopher Allan Williams concerning registration and his enrollment in the Pittsburgh Institute of Mortuary Science degree program. On a motion by Mr. Hadley, seconded by Mr. Tunnell, the Board approved his request to register provide he qualifies. Ayes: 7. Nays: 0. Motion approved.

8. A letter from Judith Riddle concerning funeral home firm title. Secretary instructed to inform Mrs. Riddle that the funeral home must reflect the name on her license.

9. A letter from Pamela J. Mathews concerning her embalmer's apprenticeship. On motion by Mr. Van Atta, seconded by Mr. Hadley, the Board approved her request to extend her apprenticeship in order to fulfill the required number of embalming cases. Ayes: 7. Nays: 0. Motion approved.

10. A letter from Brent Lasater concerning part-time employment during his apprenticeship. On a motion by Mrs. Stalzer, seconded by Mr. Hadley, the Board approved his request to work part time outside his apprenticeship, provided the work does not exceed twenty hours. Ayes: 7. Nays: 0. Motion approved.

11. A letter from Todd M. Grisier concerning a continuing education program. On a motion by Mr. Tunnell, seconded by Mr. Van Atta, the Board approved OFDA District # 1 program entitled "Life Connection of Ohio" for one hour. Ayes: 7. Nays: 0. Motion approved.

12. A letter from C. T. Halfhill concerning the annual renewal fees and retired licensees. Secretary to inform Mr. Halfhill that there are no provisions to exempt individuals from the renewal fees.

13. A letter from Randall Redington concerning an individual continuing education program. On a motion by Mr. Tunnell, seconded by Mr. Hadley, the Board approved the program entitled "Morals or Ethics" for four hours. Ayes: 7. Nays: 0. Motion approved.

14. A letter from Tina Girod concerning a continuing education program. A motion by Mr. DeJohn, seconded by Mr. Stalzer, to approved the program entitled "Funeral Home Conglomerate." Ayes: 0. Nays: 7. Motion denied.
