Tuesday - December 18, 2001

The regular meeting of the Board of Embalmers and Funeral Directors was held at the Riffe Center located in Columbus. President Ross C. DeJohn called the meeting to order at 1:35 P.M. after the annual Holiday Luncheon. Other Board members present were: Virginia S. Cheney, John J. Hadley, Pernel Jones, Sr., David B. Tobias, and Kurtis A. Tunnell. Also present were: Mollie Martin, Assistant Attorney General, Frank J. Savage, Inspector, Charles H. Wisby, Inspector, and Ann Cunningham, Executive Director. Timothy Schmidt observed the meeting.

On a motion by Mr. Tunnell, seconded by Mr. Hadley, the minutes of the November 13-14, 2001 meeting were approved. Ayes: 6. Nays: 0. Motion approved.

Announcements

Mr. Hadley reported that he spoke with the Guernsey County Funeral Directors Association concerning indigent burial, and he provided the Board members with a copy of the details worked out between the county funeral directors and county commissioners. Mr. Hadley will be paid per diem and reimbursed for travel expenses.

Inspector Savage and Mr. DeJohn spoke to the Pittsburgh Institute of Mortuary Science on December 12, 2001. Mr. DeJohn will be paid per diem and reimbursed for travel expenses.

Ms. Cunningham gave a Conference newsletter to Mrs. Cheney and Mr. Tobias, and will contact the Conference of Funeral Service Examining Boards to insure the all Board members receive correspondence from the Conference.

Ms. Cunningham informed the Board members that the Federation of Associations of Regulatory Boards (FARB) will meet in Las Vegas in February, but due to fiscal restrictions, the Board would not send a representative.

Unfinished Business

The Board members were given a report from the Joint Regulatory Boards Committee for SRS-e describing the progress on the new licensing system. The Department of Administrative Services has secured a term contract with the vendor, and four Boards will test the system.

The Board member received a copy of the December 5, 2001 newsletter from the Loewen Group announcing the company's emergence from bankruptcy as the Alderwoods Group, Inc. The Board reviewed twenty-two new applications for funeral home license submitted by the Alderwoods Group later in the meeting.

The Board received a copy of letter sent by the Joint Group of Ohio Regulatory Boards confirming the tentative agreement with the Department of Administrative Services to secure computer support by the first of calendar 2002

With the Legislature on recess until January, there was no activity on House Bill 322, House Bill 369, or House Bill 421. However, Mr. Hadley reported that he spoke with John McGough, attorney with the Ohio Funeral Directors Association expressing concerns over proposed changes in House Bill 421. Mr. McGough explained the proposals to Mr. Hadley's satisfaction.

The annual convention of the Conference of Funeral Service Examining Boards is scheduled for Saturday and Sunday, April 6-7, 2002, in Dallas Texas, and shortened from four to two days.

Correspondence

1. A letter from Joseph Nero concerning Charles R. Blessing and his alleged funeral home license. Secretary to inform Mr. Nero that on May 15, 2001, the Board voted to approve Mr. Blessing's application for funeral home license pending receipt of the occupancy permit and final inspection. To date, Mr. Blessing has not submitted an occupancy permit, there has been no final inspection, and consequently Mr. Blessing does not have a funeral home license.

2. A letter from Robert J. Liston concerning his new funeral home license and advertisements. Secretary to inform Mr. Liston that Board records will reflect the firm title as "Liston Funeral Home." In addition, the Board found no problem with the calendar advertisements being issued in December when the new funeral home license was issued.

3. A letter from John Carge Alderwoods Group, Inc.(Loewen) concerning advertising a group of funeral homes. The Assistant Attorney General will research the reference to Foresight Family Funeral Homes, and ask for information that is more specific from Mr. Carge.

4. A letter from Sherri Douglass, Executive Director of the West Virginia Board of Embalmers and Funeral Directors concerning mortuary science programs via distance learning or Internet. Secretary to inform Ms. Douglass that Ohio applicants are required to complete college degree and mortuary science programs, present transcripts of both, and then proceed to certify apprenticeships. Therefore, the problem of simultaneous completion of both mortuary science requirements and apprenticeship requirements does not exist in Ohio.

5. A letter from Frank B. Rosenacker, attorney, concerning the merger of Nurre Bros., Inc. and Mihovk-Rosenacker Funeral, Inc. The Board approved three applications for funeral home license earlier in the meeting. Secretary to amend the Board files to reflect the change in title and ownership of the three locations.

6. A letter from Raymond S. Sinchak concerning change of ownership for the Sinchak & Sons Funeral Home of Warren. The Board determined that there was no change in the majority ownership as described in Section 4717.11 of the Revised Code, and therefore, there was no need for a new application for funeral home license.

7. A letter from Thomas H. Boyer concerning ownership and firm title for the Boyer Home for Funerals & Schwartz, Spence & Boyer Home for Funerals, Inc. Secretary to inform Mr. Boyer that an amendment form is required to change the manager and funeral director actually-in-charge of and ultimately responsible for the funeral home. The Board accepted the firm title change from " Boyer Home for Funerals & Schwartz, Spence & Boyer Home for Funerals, Inc." to "Schwartz, Spence, Boyer & Cool Home for Funerals." In addition, when Robert G. Cool, Jr. achieves fifty-one per cent of the ownership, a new application for funeral home license must be filed with the Board.

8. A letter from Mathew Hollandsworth, apprentice, concerning qualifications for a master embalmer. Secretary to inform Mr. Hollandsworth that Poul Lemasters would qualify as a master because he has been licensed for five years in West Virginia and Ohio combined , as established by motion on May 15, 2001.

9. A letter from Mrs. Robert T. Dawson concerning her husband's reinstatement of licenses. Secretary to inform Mrs. Dawson of the procedure described in Section 4717.08 of the Revised Code that requires the licensee to successfully pass examinations, and to pay renewal and penalty fees.

Inspectors' Reports

Inspector Savage reported that he drove 1,605 miles in the counties of Ashtabula, Columbiana, Crawford, Geauga, Mahoning, and Stark. He made 45 inspections, 4 investigations, found three violations, and monitored one apprentice. Inspector Savage attended computer training November 15, 2001

Inspector Wisby reported that he drove 2,496 miles in the counties of Butler, Franklin, Hamilton, Jackson, Licking, Lucas, Montgomery and Wood. He made 49 inspections, 5 investigations, found no violations, and monitored four apprentices. Inspector Wisby attended OSHA training on November 7, 2001, and computer training on November 15, 2001.

Executive Session

On a motion by Mr. Hadley, seconded by Mr. Jones, the Board went into executive session pursuant to Section 121.22(G)(1) of the Revised Code, to consider complaints and possible disciplinary action against licensees, and Section 121.22(G)(3) of the Revised Code to conference with the Board's counsel to consider pending litigation. Roll call vote: Cheney, Aye; DeJohn, Aye; Hadley, Aye; Jones, Aye; Tobias, Aye. Mr. Tunnell left the meeting at this point in the agenda.
